Disengaged Employees Sue CBN, Seek Compensation

By Divine Perezide
A legal battle is unfolding between the Central Bank of Nigeria (CBN) and a group of former employees who were dismissed as part of a mass termination exercise earlier in 2024. The aggrieved staff have approached the National Industrial Court of Nigeria (NICN) in Abuja, alleging that their dismissals were unlawful and violated both internal policies and Nigerian labour laws.
The former employees, represented by Stephen Gana and 32 others, filed a class-action suit challenging the termination, which they claim was carried out without proper consultation or adherence to fair hearing procedures as required by law.
Court documents reveal that the terminations were communicated through letters titled “Reorganisational and Human Capital Restructuring” dated April 5, 2024. The claimants argue that this action breached Section 36 of the Nigerian Constitution, as well as the CBN’s Human Resources Policies and Procedures Manual (HRPPM).
One of the key issues raised in the suit is whether the affected staff were denied their constitutional right to a fair hearing before and after the termination of their appointments. The claimants maintain that the entire process was arbitrary, citing the lack of consultations with the Joint Consultative Council, a step required by Article 16.4.1 of the HRPPM.
According to the court filing, the disengaged employees were given only three days to vacate their positions and hand over official assets. They argue that this short notice disregarded established procedures meant to ensure fairness in employment-related decisions.
The claimants are asking the court to declare their terminations null and void, insisting that they remain legitimate employees of the apex bank. They are also seeking reinstatement to their roles, payment of all salaries and benefits from the time of their dismissal, and an injunction preventing the CBN from initiating any further terminations without following due process.
Meanwhile, a Facebook user affiliated with the South-South PDP Forum criticized the exercise, stating, “We were told by the CBN governor that it is voluntary disengagement, so it was another APC lie.”
The case, which was filed on July 4, 2024, under the NICN Civil Procedure Rules 2017, is expected to test the boundaries of labour rights and internal policies in Nigeria’s financial sector.
