Supreme Court withholds judgment on appeal challenging Oborevwori’s 2023 election triumph.

By Anthony Beauty,

The Supreme Court is yet to deliver its verdict on the appeals filed by the candidates of the All Progressives Congress, Social Democratic Party, and Labour Party in the Delta state governorship election.

The Lagos Court of Appeal upheld Sheriff Oborevwori’s election as Delta State governor, rejecting appeals from opposing candidates and their parties.

Oborevwori secured victory with 360,234 votes, surpassing his nearest rival, Ovie Omo-Agege of the All Progressives Party, who garnered 240,229 votes.

Ken Pela, representing the LP, secured the third position with 48,027 votes, while Great Ogboru from the All Progressives Grand Alliance claimed the fourth spot with 11,021 votes.

Omo-Agege’s counsel argued that certain recorded results lacked serial numbers, contending a violation of section 73(2) of the Electoral Act.

The counsel for Omo-Agege pointed out that the evidence presented to support this was overlooked in the lower courts.

“Some of the recorded results across specified polling units did not have serial numbers.

“The provisions in section 73(2) state that there should be a record. It also provides for the compulsory invalidation of an election conducted without serial numbers.

“The Lower courts did not give slots to these exhibits. Evidence tendered has been ignored. Notwithstanding, the concurrent judgments, my lords should set aside these judgments,” He said.

Joseph E. O Abubu, representing the first respondent, urged the court to dismiss the appeal, citing section 137 of the Electoral Act.

Pela from the LP urged the Supreme Court to invalidate the entire election and call for a new poll.

SDP candidate Kenneth Gbagi claimed the governor was ineligible for the election, urging the court to invalidate his victory.

The panel, headed by John Okoro, reserved judgments on the matters after hearing arguments from the parties.

FUBARA AND SUPPORTERS CELEBRATE AFTER APEX COURT UPHELD HIS ELECTION VICTORY.

By Tobouke Jemine,

In Rivers State and across the Niger Delta, supporters and well-wishers of the Governor of Rivers State jubilate and congratulate him following the Supreme Court’s affirmation of Independent Electoral Commission’s declaration of Siminalayi Fubara as the winner of the last gubernatorial in Rivers State on Thursday.

Following INEC’s declaration, the All Progressives Congress candidate in the Rivers State governorship election, Tonye Cole, alleged that Fubara did not resign from his previous position as required by law before the election and that the election itself was characterized by irregularities.

Hence, Cole sought the face of the law to ascertain his claims. But when both the tribunal and the Court of Appeal dismissed Cole’s case for lack of merit, Cole appealed to the apex court to sack Siminalayi Fubara as governor of the state.

But reading the lead judgment, Justice Ibrahim Saulawa dismissed Cole’s appeal. Unanimously, the five-man panel on Thursday held that the appellant failed to prove his allegations that there was non-compliance with the Electoral Act during the election.

Following the confirmation of his electoral victory, Governor Siminalayi Fubara on Thursday attended the 4th day of Glory Reign at Salvation Ministry in Port Harcourt, to thank God.The annual church event which began on Monday, January 22, 2024, saw the General Overseer, Pastor David Ibiyomie preach on the theme, “Vengeance for Victory”.

Fubaraubara thanked God and President Bola Tinubu for his fatherly role touching the internal crisis in the party in the State and the litigation against his election.

Fubara also extended his magnanimity and gratitude to the Minister of the Federal Capital Territory, Nyesom Wike, whom he described as his “Oga” for all his support.

The governor called on everyone to join hands with his administration make Rivers State a truly prosperous and advanced state in all ramifications.
